Bias Against Criminal Offenders Based On LGBTQ+ Identity

Bias against LGBTQ+ people is well documented, but it is less well known how this affects their experiences in the criminal justice system, for example, regarding arrests and in trials. Still, with virtually no research confirming or disconfirming the presence of bias, we do not know the extent to which bias may or may not influence these criminal justice outcomes. This study aims to measure bias as it affects justice-involved gay and lesbian individuals. Using a 2x2 vignette structure (male/female offender, male/female romantic partner), this study attempts to measure differences in stigma faced by gay, lesbian, and straight men and women as well as any differences in punitive sentencing attitudes. Results bear on equity during jury trials and should inform the role of unconscious bias in sentencing.
